HS2 - Route Wide Injunction

Mr Justice Julian Knowles today granted an injunction which, among other things, makes it a contempt of court for
'Persons Unknown' to enter or remain without consent on 'HS2 Land' - all of it.

The Order

The claimants are HS2 Ltd & the SoS for Transport (whomsoever (s)he may be this week). Five categoreis of defendant are identified, of which the first and last are occupants of Cash's Pit, or named individuals.

  1. Are 'Persons Unknown' entering or remaining without the consent of the claimants (on HS2 Land) with the effect of damaging, delaying or hindering the claimants or their various agents.
  2. Are also 'Persons Unknown' obstructing or interfering with access or egress from HS2 Land, with the effect of delaying or hindering the claimants or their agents ( presumably when entering or exiting from the land, although that is not stated)
  3. Relates to 'Persons Unknown' interfering with gates and locks

Anyone disobeying the order may be held in contempt of court, and may be fined or imprisoned. (Trespass is in itself a civil offence ). The order expires on31-May-2023, unless renewed.

The “HS2 Land” means all of the land acquired or held by the Claimants in connection with the High Speed 2 Railway Scheme shown coloured pink and green on the plans which are available electronically on the HS2 Proceedings Website

The Claimants confirm that this Order is not intended to prohibit lawful protest which does not involve trespass upon the HS2 Land and does not block, slow down, obstruct or otherwise interfere with the Claimants’ access to or egress from the HS2 Land.
